Legal Requirements for Marriage in Australia
Ø Notice of Intended Marriage: Before you can marry, you are required by law to lodge a Notice of Intended Marriage one calendar month and one day before your wedding day. This NOIM is valid for 18 months from the date of submission. This form can be submitted in person, faxed or mailed.
Ø Birth Certificate: You must be over 18 years of age to marry or special permission from the courts is required. Birth certificates are required to be sighted by your Marriage Celebrant. (For persons from another country, either a passport or a birth certificate translated into English is required)
Ø Divorce Decree Paper or Death certificate: If you have been previously married, you will be required to produce your Divorce Decree Absolute paper or a Death Certificate depending on how your previous relationship ended.
Ø Witnesses: You will need to have two witnesses (aged 18 or over) on the day of your wedding.
